A judge in Georgia found that a group of voters who had challenged her eligibility failed to prove she engaged in insurrection after taking office. The decision will be made by the Republican Secretary of State.

The daylong hearing in April included arguments from lawyers for the voters as well as extensive questioning of the candidate. Both sides gave him extensive briefings.

State law requires Beaudrot to submit his findings to Raffensperger, who has to decide whether or not to remove Greene from the ballot.

The secretary of state will release his final decision soon, according to an email from a Raffensperger spokesman.

The voters who filed the challenge alleged that the GOP congresswoman played a role in the Jan. 6, 2021, riot that disrupted the presidential election. They argue that she is ineligible to run for reelection because of the 14th Amendment having to do with insurrection.

Ron Fein, a lawyer for the voters who filed the challenge, noted that in a TV interview the day before the attack on the U.S. Capitol, the next day would be our 1776 moment.

Fein said that it turned out to be an 1861 moment, alluding to the start of the Civil War.

One of the GOP's biggest fundraisers in Congress is a conservative firebrand who has become an ally of Trump. He was questioned under oath. She denied ever supporting violence and said that she didn't recall any of the statements attributed to her.

She acknowledged encouraging a rally to support Trump, but she didn't know that there were plans to storm the Capitol or disrupt the electoral count with violence. During the riot, she used social media to encourage people to remain calm and to be safe.

The 14th Amendment states that anyone who has previously taken an oath to support the Constitution of the United States cannot serve in Congress.

Fein said that she helped facilitate violent resistance to our own government, our democracy and our Constitution.

James Bopp argued that his client was a victim of the attack on the Capitol, not a participant, and that she engaged in protected political speech.

There is no evidence that she was involved in the attack on the Capitol.

The exact parameters of the meaning of the 14th Amendment and assuming for these purposes that the Invasion was an insurrection, Challengers have produced insufficient evidence to show that Rep.

Her statements are protected by the First Amendment and may have contributed to the environment that led to the attack.

Five voters in her district filed a challenge to her eligibility to run for reelection, and the procedure for such a challenge is outlined in Georgia law. Beaudrot's decision is not binding on Raffensperger, who must determine if Green is qualified to run for reelection.

Either side has 10 days to appeal to the Fulton County Superior Court. On the May 24 ballot, he is facing a Republican primary challenge after he refused to bend to pressure from Trump to overturn Joe Biden's victory in Georgia. In his book, Raffensperger wrote that the attack on the Capitol in 2021 was highly objectionable and people were trying to downplay it.

Free Speech for People, a national election and campaign finance reform group, filed a complaint on behalf of five voters in Georgia. In Arizona and North Carolina, the group filed similar challenges.

The voters are trying to keep her off the ballot and that's why she has filed a federal lawsuit. There is a pending suit.
