The man accused of attacking Dave Chappelle during a stand-up comedy show will be charged with four counts of simple assault.
The office of the district attorney prosecutes misdemeanor crimes in Los Angeles and has charged the man with battery, which carries a maximum sentence of six months in county jail or $2,000 in fines.
Lee was also charged with possession of a weapon with intent to assault and with two local offenses related to disrupting performances.
While criminal conduct occurred, the evidence presented did not constitute felony conduct, according to the Los Angeles County District Attorney's office.
The replica gun found in Lee's bag wasn't brandished during the attack, so the office decided not to charge Lee with a felony.
Feuer said in a video statement that the alleged attack has to have consequences.
The Los Angeles Police Department said in a statement that Lee tackled Chappelle during a comedy festival at the Hollywood Bowl. Police say Chappelle wasn't hurt during the incident and that Lee was subdued by the venue's security staff and later arrested and jailed on $30,000 bail. Chappelle is fully cooperating with the police investigation, according to his representative.
