The man accused of attacking Dave Chappelle on stage during a stand-up comedy show can still be charged with a misdemeanour.
While criminal conduct occurred, the evidence presented did not constitute felony conduct, according to a statement from the district attorney.
The case was referred to the Los Angeles City Attorney's Office.
A representative for Chappelle told Forbes that the comedian is fully cooperating with the police investigation.

A man from the audience tackled Chappelle during a comedy show at the Hollywood Bowl. The Los Angeles Police Department said that Chappelle was not hurt when the man held a replica handgun and knife. He was held on $30,000 bail after being arrested for felony assault with a deadly weapon. In a statement to Forbes on Wednesday, the company said it was proud to defend the right of stand-up comedians to perform without fear of violence. Sims said the attack was unfortunate and frightening.
Chris Rock, who was slapped on stage at the Oscars by Will Smith after he joked about his wife Jada Pinkett Smith, was present for Chappelle's attack. Rock took the stage after Chappelle was tackled and joked about Will Smith.
