Louisiana lawmakers advanced a bill out of committee that could make abortion grounds to be charged with homicide, if the Supreme Court overturns Wade or not.
The Louisiana House Appropriations Committee passed the bill in a 7-2 vote and will now go to the full House for debate.
The bill fully recognizes.
the human personhood of an unborn child” starting at the “moment of fertilization” and grants embryos and fetuses the same rights under law as human beings out of the womb.It would be classified as homicide if you assisted or performed an abortion.
If federal abortion rights are still in place and the Supreme Court hasn't changed their minds, the legislation will take effect immediately.
The bill states that any judge who tries to block the law should be removed.
The legislation is likely to be tied up in court if it is enacted into law, as proponents of the bill acknowledged Wednesday.
The consequences of the legislation could be far-reaching. Critics pointed out during the hearing Wednesday that the bill could be used to punish those who participate in in-vivo fertilization, as not all eggs fertilized during in-vivo fertilization may be successful in bringing about a pregnancy. Attorneys opposed to the bill noted Wednesday that it could be used to punish those who take birth control pills, which prevent fertilization, or emergency contraception methods like Plan B.
The Advocate reported that a New Orleans lawyer told the committee that the bill undermines the very system of government in this country. The bill is bad. This bill is unconstitutional.
The Louisiana bill moved forward two days after it was reported that the Supreme Court may soon allow states to outlaw abortion. The state has atrigger ban on abortion which makes it a crime to perform an abortion if you are found guilty of a crime. While many abortion bans will make it a felony to perform an abortion, no one will punish the person having the abortion themselves.
Louisiana could become a crime of murder if the Supreme Court doesn't rule on abortion.
If the abortion law is changed, it will become a felony in these states.
If the Supreme Court overturns the Wade decision, what will happen?
